Terms of Service

1. Scope and Acceptance

These Terms of Service govern the use of the TrustCamera website and web application, operated by TrustCamera GbR. By using the service, you accept these terms in full. Use is entirely at your own risk.

2. Exclusion of Liability

By using the website and web application, we exclude all claims for recourse due to damage, loss, or other events. TrustCamera GbR, its representatives, and affiliates assume no liability whatsoever for any direct, indirect, incidental, consequential, or special damages arising from the use of the service. This applies regardless of the legal basis.

3. Misuse and Fraud

TrustCamera GbR assumes no liability if third parties manage to cause financial damage through deception, fraud, or similar actions using our service. The service is a tool for photo verification and does not replace the user's own due diligence.

4. Storage and Processing of Photos

We expressly point out that uploaded photos are processed and stored by us. Storage is for an indefinite period. Photos are accessible to anyone who has the corresponding image code (hash). By using the service, you consent to this processing and storage.

5. Blockchain Data

The approximate location (accuracy approx. 1 km), the capture time, and the SHA-256 hash of the original photo are stored on the blockchain. This data is immutable and cannot be deleted due to the nature of blockchain technology. The original photo cannot be reconstructed from the SHA-256 hash with current technology. Only the approximate location is stored, not the exact position.

6. Deletion of Photos

Photos can be deleted at any time upon request. Please use the contact form and provide the image code. We will process deletion requests as promptly as possible. Please note that blockchain entries (hash, approximate location, timestamp) cannot be deleted.

7. Prohibited Content

It is prohibited to upload, publish, or distribute photos containing criminal material through the service. This also applies to violations of the German Art Copyright Act (Kunsturheberrechtsgesetz, KUG). In particular, publishing photos of persons without their consent may be punishable by law. Users are solely responsible for the content they upload.

8. Availability

Access to photos may be disrupted by maintenance work. The availability of the web application cannot always be guaranteed. TrustCamera GbR assumes no liability for temporary or permanent unavailability of the service.

9. Changes to Terms

TrustCamera reserves the right to modify these Terms of Service at any time. The current version is always available on this page. Continued use of the service after changes constitutes acceptance of the updated terms.

10. Governing Law

These Terms of Service are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Kaiserslautern, Germany, to the extent permitted by law.
